Terms and Conditions

1. Acceptance of the terms

By creating an Aro ("Aro", "we") account or using any of its services, you accept these terms and conditions in full. If you disagree with any part, you must not use the platform.

Aro is a booking-management SaaS platform that lets businesses (the "Operators") publish their services or experiences, manage their availability, team, and pricing, and receive bookings and payments from their end customers (the "Customers").

2. Definitions

"Operator": the business that contracts Aro to manage its bookings and, where applicable, collect online payments.

"Customer" or "end customer": the person who makes a booking with an Operator through the platform.

"Reseller": the person or agency authorized by an Operator to offer its experiences at its own public price, under the optional reseller module described in section 8.

"Content": any information, text, image, or data that an Operator publishes or uploads to the platform.

3. Account registration and verification

To use the operator panel you must register with a valid email address, verify it, and accept these terms and the privacy notice. Registration includes automated anti-bot verification (captcha).

You must be at least 18 years old, or the legal age of majority in your jurisdiction, to register an Operator account. The platform is not directed at minors and we do not knowingly collect data from minors; if we detect an account registered by a minor, we will suspend it.

You must provide truthful information about yourself and your business and keep it up to date. We reserve the right to suspend accounts created with false information or through unauthorized automated means.

4. Account security and two-factor authentication

You are responsible for keeping your password confidential and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.

Aro offers two-factor verification (TOTP) and single-use backup codes as an additional security measure. If you enable this feature, you are responsible for safeguarding your authenticator app and backup codes; losing both may prevent access to your account.

If you add team members to your account (Users and Roles module), you are responsible for the actions they take with the permissions you grant them and for revoking their access when appropriate.

5. Plans, subscriptions, and billing

Aro offers a free plan and paid plans with additional features, including a fixed-subscription model and, depending on the plan, a commission or pay-as-you-go ("PAYG") model. The prices, limits, and modules included in each plan are described on the pricing page and may be updated with prior notice.

Paid subscriptions are charged on a recurring basis through our payment processor (Stripe). You can change or cancel your plan at any time from the panel; upgrades and downgrades are prorated automatically, and access to paid features remains until the end of the period already billed.

If your paid subscription is cancelled or past due, we may restrict access to the operator panel until the situation is resolved, without affecting bookings already confirmed with your customers.

6. Payments, commissions, and payout accounts

To receive online payments from your customers you must complete the identity verification (KYC) process required by our connected-accounts payment provider (Stripe Connect) or, where applicable, Mercado Pago. Aro is not a financial or payment institution: funds flow directly between the Customer and your account with the payment processor.

Depending on your plan, Aro may automatically withhold a commission ("application fee") on each payment processed online, deducted directly by the payment processor before settling the remainder to you. The applicable rate is shown in your subscription panel.

Aro never stores your customers' or your full card number; that information is captured and processed directly by the payment processor, which complies with the PCI-DSS standard.

You are responsible for complying with your tax obligations regarding income received through the platform.

7. Cancellations, refunds, and manual payments

Cancellation and refund policies toward the Customer are defined and applied by the Operator. When the Operator requests a refund through the panel, it is processed via the corresponding payment provider according to its own timelines and conditions.

The Operator may manually record payments received outside the platform (cash, transfer, or another method) for internal control purposes; recording a manual payment is the Operator's sole responsibility and does not mean Aro processed or verified that payment.

8. Reseller program

Operators who activate the Resellers module may authorize third parties to offer their experiences at their own public price, equal to or higher than the reporting price set by the Operator. Aro provides the technical infrastructure (attribution links, reseller portal, and booking records), but is not a party to the commercial relationship or the settlement of margins between the Operator and the Reseller, except in the net-price online-charge mode, where section 6 applies.

The Operator is responsible for verifying the identity and suitability of the Resellers it approves and for handling any dispute with them.

9. Content published by the Operator

The content you publish on the platform (service names, descriptions, images, prices, and availability) is your property and responsibility. You warrant that you hold the rights needed to publish it, including any image or material you upload to our file storage, and that it does not infringe third-party rights or contain third-party personal data without a legal basis to do so.

You grant us a limited, non-exclusive, revocable license to host, display, and distribute that content for the sole purpose of operating the platform, including your public booking catalog and any calendar feed you generate.

10. Automated communications

By using the platform, you authorize Aro and, where applicable, its messaging providers, to send on your behalf and on behalf of your customers the transactional communications necessary for the service: booking confirmations, reminders, payment notices, security alerts, and account notifications, by email and/or WhatsApp.

These communications are necessary to provide the service and do not constitute marketing; we do not use them for third-party advertising purposes.

11. Acceptable use

You may not use Aro for illegal, fraudulent, or deceptive activities; to offer goods or services prohibited by law; to send unsolicited communications (spam); to attempt to access other users' accounts or data; to circumvent captcha mechanisms, usage limits, or security controls; or to interfere with the operation, security, or availability of the platform.

You also may not use the manual-booking or "offline payment" module to simulate non-existent transactions for money-laundering or tax-evasion purposes.

Breaching these rules may result in the suspension or deletion of the account, and where applicable a report to the competent authorities, with no right to a refund.

12. Bookings and relationship with end customers

Aro acts solely as a technological intermediary between the Operator and its Customers. The delivery of the booked service, its quality, cancellations, refunds, and any dispute with the Customer are the exclusive responsibility of the Operator.

13. Data protection

We process personal data in accordance with our privacy notice and applicable law. With respect to your end customers' data, the Operator acts as data controller and Aro as processor; the Operator undertakes to use that data solely to manage bookings and related communications, and to have a legal basis to share it with Aro.

14. Aro's intellectual property

The software, brand, logo, and design of the platform are the property of Aro or its licensors. These terms do not grant you any right over them beyond the use of the platform as agreed herein.

15. Service availability

We aim to keep the platform continuously available, but there may be interruptions due to maintenance, force majeure, or failures of our providers (including payment processors, hosting, and messaging). We do not guarantee uninterrupted availability.

16. Limitation of liability

The platform is provided "as is" and "as available". To the maximum extent permitted by law, Aro will not be liable for indirect damages, loss of profits, or loss of data arising from the use of, or inability to use, the service, nor for failures attributable to payment processors, messaging providers, or hosting providers.

In no event will Aro's total liability toward an Operator exceed the amount paid by that Operator to Aro during the three months preceding the event giving rise to the claim.

17. Suspension and termination

You may close your account at any time from the panel or by requesting it at [email protected]. We may suspend or cancel your account if you breach these terms, for non-payment, or upon legal requirement.

When an account is closed, we will retain the data we are legally required to keep (for example, tax or payment records) and delete or anonymize the rest in accordance with our privacy notice.

18. Governing law and jurisdiction

These terms are governed by the laws of the United Mexican States. For any dispute, the parties submit to the competent federal courts under those laws, waiving any other venue that might correspond to them by reason of their present or future domicile.

19. Changes

We may update these terms to reflect changes in the service or in legislation. We will publish the current version on this page indicating the date of the last update and, in case of material changes, we will notify you by email. Continued use of the platform after an update constitutes acceptance.
